ESL RECRUITMENT LIMITED Recruitment Limited (“ESL RECRUITMENT LIMITED”)
Standard Terms of Business for Candidates looking for Permanent Work (“Terms”)
These Terms are effective from 1st March 2013 and supersede all previous terms of business. All and
any business undertaken by ESL RECRUITMENT LIMITED for Candidates looking for permanent work is done subject to these Terms and in ESL RECRUITMENT LIMITED’s capacity as an Employment Agency. In these Terms words importing the singular shall include the plural and vice versa and words importing the masculine gender shall include the feminine gender and vice versa.
‘Candidate’ means a person seeking work using ESL RECRUITMENT LIMITED’s recruitment services with a view to being
employed on a permanent basis by a Recruiter;
‘Recruiter’ means the person or business instructing ESL RECRUITMENT LIMITED to source and introduce Candidates to it (or any of its subsidiary undertakings or associates as such terms are defined by the Companies Act 2006) with a view to employing a Candidate on a permanent basis, or a person or business to whom a Candidate is introduced by ESL RECRUITMENT LIMITED for the same purpose;
‘ESL RECRUITMENT LIMITED’ means ESL RECRUITMENT LIMITED Recruitment Limited of International House, 24 Holborn Viaduct, London, EC1A 2BN, United Kingdom and registered under Company No 11036746 or any of its subsidiary, associated or holding companies;
2. Obligations of the Candidate
2.1 Before ESL RECRUITMENT LIMITED can begin to seek work on behalf of the Candidate, the Candidate must provide ESL RECRUITMENT LIMITED with a copy of his CV (curriculum vitae), full details of the work for which it would like to be considered and all other associated matters to enable ESL RECRUITMENT LIMITED to arrange an introduction with a Recruiter including, without limitation: -
2.1.1 acceptable proof of identity and Citizenship or right to work in Vietnam or given countries;
2.1.2 full details together with supporting evidence of the relevant experience, training,
qualifications and professional body authorisations of the Candidate; and
2.1.3 the names of two referees (who are not relatives of the Candidate) who the Candidate
agrees for ESL RECRUITMENT LIMITED to approach at any time for the purpose of obtaining references about the Candidate.
2.2 By providing the information referred to in clause 2.1 the Candidate consents to its disclosure,
and the disclosure of any other information held by the Company relating to the Candidate, to
any Recruiter in order to progress any introduction or work application.
2.3 The Candidate warrants that all and any information or other details provided or supplied to
ESL RECRUITMENT LIMITED by the Candidate is true, complete, accurate and up to date.
2.4 The Candidate acknowledges that it will not engage in any conduct which could be detrimental
to the interests of a Recruiter or ESL RECRUITMENT LIMITED. The Candidate shall immediately inform ESL RECRUITMENT LIMITED should it become aware of any circumstances under which it would be detrimental to the interests of ESL RECRUITMENT LIMITED, the Recruiter or the Candidate for the Candidate to take up employment with the Recruiter.
2.5 The Candidate agrees to notify ESL RECRUITMENT LIMITED immediately upon receiving an offer of employment from a Recruiter and will provide full details of the terms of the offer and in particular the remuneration and benefits package. ESL RECRUITMENT LIMITED accepts no liability for any loss or expense suffered by the Candidate should the Recruiter withdraw any offer of employment at any time for any reason. Furthermore, ESL RECRUITMENT LIMITED accepts no responsibility or liability or any loss or expense suffered by the Candidate by reason of his decision to resign from his current employment or work before or after receipt of the Recruiter’s offer of employment.
2.6 The Candidate is fully aware that in the event ESL RECRUITMENT LIMITED receives or obtains information indicating that the Candidate is or may be unsuitable to work for or be employed by the Recruiter ESL RECRUITMENT LIMITED may be obliged to, and if so, will inform the Recruiter of this information.
2.7 The Candidate acknowledges and agrees that all inbound and outbound calls made to or from
ESL RECRUITMENT LIMITED may be recorded for training and monitoring purposes.
2.8 The Candidate agrees that ESL RECRUITMENT LIMITED may, from time to time, contact the Candidate by way of E-mail, SMS, telephone, voice broadcast, or any other type of communication.
3. ESL RECRUITMENT LIMITED’s Obligations
3.1 When the Candidate provides ESL RECRUITMENT LIMITED with a copy of his CV (and any other information required by ESL RECRUITMENT LIMITED under clause 2.1 above), ESL RECRUITMENT LIMITED will use reasonable endeavours to look for permanent employment work for the Candidate and where appropriate, introduce the Candidate to a Recruiter. Introductions will only be made if ESL RECRUITMENT LIMITED, at its sole discretion, considers it appropriate to do so. ESL RECRUITMENT LIMITED is under no obligation to actually find employment for the Candidate. The Candidate accepts that ESL RECRUITMENT LIMITED can give no warranty as to the ultimate suitability of any vacancy it does find.
ESL RECRUITMENT LIMITED cannot guarantee to find a suitable vacancy for each Candidate nor that a Candidate will be ultimately selected by a Recruiter.
3.2 An offer of employment made to a Candidate may be subject to the Recruiter obtaining satisfactory references or background checks on the Candidate.
3.3 ESL RECRUITMENT LIMITED shall not under any circumstances enter into a contract with a Recruiter on behalf of the Candidate. If the Candidate accepts an offer of employment from a Recruiter, he shall contract with the Recruiter directly.
3.4 ESL RECRUITMENT LIMITED undertakes that all services provided by it to the Candidate under these Terms will be provided free of charge.
3.5 The Company is acting as an Employment Agency (as defined in the Employment Agencies Act
1973 as amended) when dealing with any permanent placement.
4. Data Protection Act 1998
For the purposes of the Data Protection Act 1998 the Candidate agrees and acknowledges that ESL RECRUITMENT LIMITED may hold and process personal data (including sensitive data) of which it is the subject for all matters and purposes connected to ESL RECRUITMENT LIMITED’s business and in particular to the introduction of the Candidate to a Recruiter in accordance with these Terms. The Candidate agrees that by accepting these Terms it has given its consent to ESL RECRUITMENT LIMITED processing and storing such personal data (including sensitive ESL RECRUITMENT LIMITED Standard Terms data) concerning the Candidate as required by the Data Protection Act 1998. Such processing will be for administrative, advertising and purposes and in the furtherance of our business relationship with you. For the purpose of this clause “sensitive data” means personal data consisting of information of national or ethnic origin; political opinions; religious beliefs or other beliefs of a similar nature; membership of a Trade Union; physical or mental health or conditions; sexual life; the commission or alleged commission of any offence, or any proceedings for any offence committed or alleged to have been committed, including the disposal of such proceedings or the sentence of any court proceedings.
5.1 These Terms shall be governed by and construed in accordance with the laws of England and Wales.
5.2 By registering with ESL RECRUITMENT LIMITED and/or instructing ESL RECRUITMENT LIMITED to look for work for you on your behalf at any time and from time to time, you the Candidate will be deemed to accept these Terms.
